Welcome to SnapGPT! These Terms of Service ("Terms") govern your use of the SnapGPT browser extension ("Extension") and its related services (collectively, "Services"). By installing or using SnapGPT, you agree to these Terms. If you do not agree, do not use the Services.

Independence Disclaimer: SnapGPT is an independent service and is not affiliated with, endorsed by, or connected to OpenAI, Anthropic, or any of their products (including ChatGPT and Claude). We operate as a completely independent entity.

1. Acceptance of Terms

By accessing or using SnapGPT, you confirm that you:

• Are at least 18 years old or have permission from a legal guardian to use the Services.
• Agree to comply with these Terms and all applicable laws and regulations.

2. Use of the Services

You are granted a limited, non-exclusive, non-transferable license to use SnapGPT for personal, non-commercial purposes. You agree that you will not:

• Reverse-engineer, modify, or attempt to extract source code from SnapGPT.
• Use the Services to collect or process sensitive or illegal content.
• Use the Services for purposes that violate any law or regulation.

3. Academic Integrity

Important Notice for Students: Use SnapGPT for studying, practice, and review. Do not use during proctored tests, timed quizzes, or where prohibited. Follow your school's honor code.

SnapGPT is designed to be an educational aid that helps you learn and understand concepts. It should complement your studies, not replace your own academic work. Always ensure that your use of SnapGPT aligns with your institution's academic integrity policies.

4. Prohibited Submissions

SnapGPT uses AI to analyze submitted content, and users are prohibited from submitting any material that:

• Violates laws or regulations, including but not limited to copyrighted material without authorization.
• Contains harmful or malicious content, such as viruses, malware, or phishing links.
• Promotes illegal activities, including fraud, hacking, or terrorism.
• Contains personal or sensitive information of third parties without their consent.
• Includes offensive or discriminatory content, such as hate speech or harassment.
• Depicts or references explicit material, including exploitation or non-consensual content.
• Attempts to deceive or manipulate SnapGPT's AI systems.

5. User Responsibilities

When using SnapGPT, you agree to:

• Use the Extension only as intended.
• Ensure that any submitted data complies with these Terms.
• Protect your login credentials and personal data.

6. Data Collection and Privacy

SnapGPT's data collection practices are outlined in our Privacy Policy. Key points include:

• We collect screenshots from your active browser tab when you initiate the analysis feature.
• We collect and store email addresses for account creation, authentication, and verification.
• We track usage data including quotas, pro user status, and account information.
• Interaction Logging: When you use ScreenSnap or text analysis features, we log each interaction including your questions, AI responses, response times, user email, and browser information for service improvement purposes.
• Human Monitoring: Logged interactions may be monitored by human reviewers strictly for improving our service quality, as we are still in early development.
• Data Access: Only SnapGPT has access to your logged interactions and personal information beyond the necessary sharing with AI service providers (OpenAI and Anthropic) for processing your requests. We never share or sell this data with third parties for commercial purposes.
• Your content is processed using third-party AI models including Claude Sonnet 4, Claude 3.7 Sonnet, GPT-4.1, and GPT-4.1-Mini.
• We use Google Firebase for user authentication and data storage.

7. Intellectual Property

All rights to SnapGPT are owned by SnapGPT or its licensors. You may not:

• Copy or create derivative works without permission.
• Use SnapGPT trademarks without authorization.

8. Updates and Changes

SnapGPT may be updated periodically. Continued use constitutes acceptance of any changes.

Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, including but not limited to:

• Usage quotas, limits, or allowances
• Subscription plan features or benefits
• Pricing and billing terms
• AI model availability or capabilities

Such modifications may be necessary for operational sustainability, cost management, compliance with third-party service providers, or technical limitations. We will provide reasonable advance notice when possible, typically 30 days for material changes to paid plans.

If a modification materially reduces the services you receive under an annual subscription, you may be eligible for a prorated refund for the unused portion of your subscription period, at our sole discretion.

9. Monitoring and Service Improvement

To maintain and improve our service quality:

• Comprehensive Interaction Logging: We monitor and log all ScreenSnap and text analysis interactions, including your questions/queries, AI responses, response times, user email, browser information, and any screenshots submitted.
• Human Review: Logged interactions may be monitored and reviewed by human staff members strictly for service improvement purposes, as we are still in early development stages. This helps us enhance accuracy, fix bugs, and improve overall service quality.
• AI Processing: Your content is shared with AI service providers (OpenAI and Anthropic) solely for processing your requests and generating responses.
• Data Access: Only SnapGPT has access to your logged interactions and personal information beyond the necessary sharing with AI service providers for processing. We never share or sell this data with third parties for commercial purposes.
• Usage Monitoring: We monitor usage patterns and errors for debugging and improving the extension.
• Quota Management: We implement usage quotas and track consumption to maintain fair use of our services.

10. Termination of Use

We reserve the right to suspend or terminate access to our Services at any time, with or without cause, including but not limited to:

• Violations of these Terms
• Operational or business reasons
• Unsustainable usage patterns that threaten service availability
• Technical limitations or third-party service disruptions
• Suspected fraudulent or abusive activity

In cases of termination for non-violation reasons, we may, at our sole discretion, provide a prorated refund for any unused portion of prepaid subscriptions.

11. Disclaimer of Warranties

SnapGPT is provided "as is" without warranties. We do not guarantee uninterrupted or error-free service.

12. Limitation of Liability

SnapGPT is not liable for indirect damages or loss of data. Your sole remedy is to stop using the Extension.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes will be resolved in the courts of Texas.

14. Changes to These Terms

We may update these Terms periodically. Changes will be communicated through the browser extension store or directly in the Extension.

15. Refund Policy

SnapGPT subscriptions are billed in advance on a recurring basis and are non-refundable by default. We do not offer automatic refunds for forgotten cancellations, unused time, or dissatisfaction with AI responses.

However, we understand that special circumstances may arise. You may contact us at support@snapgpt.me within 7 days of the charge to request a refund. Requests will be reviewed manually on a case-by-case basis, and a refund may be granted at our sole discretion.

Submitting a refund request does not guarantee approval. In most cases, especially where the subscription was active and functioning as intended, refunds will not be issued.

Service Modification Refunds

If we materially modify or discontinue services during an active subscription period due to operational necessity, sustainability concerns, or business reasons, we may offer prorated refunds for the unused portion of annual subscriptions, calculated from the effective date of the modification. Such refunds are provided entirely at our discretion and are not automatic.

Annual subscribers acknowledge that service features, quotas, and capabilities may change during their subscription period, and that continued use after receiving notice of such changes constitutes acceptance of the modified terms.

16. Annual Subscriptions

Annual subscription plans are offered at discounted rates in exchange for longer-term commitment. However, these plans are subject to the following important conditions:

• Service Modifications: We reserve the right to modify service features, usage quotas, or capabilities at any time during the annual term for reasons including but not limited to cost management, operational sustainability, or technical limitations.
• No Guaranteed Limits: While some plans may be described as offering "unlimited" or high usage allowances, such terms are subject to fair use policies and may be modified if usage patterns threaten service sustainability or violate our acceptable use guidelines.
• Early Modification Rights: If service modifications materially reduce your subscription benefits, we may choose to provide prorated refunds and terminate the annual subscription early, rather than continuing service under modified terms.
• Notification: Material changes to annual subscriptions will be communicated with reasonable advance notice, typically 30 days when possible.
• Acceptance: By purchasing an annual subscription, you acknowledge and accept that service terms may change during your subscription period, and that such changes do not automatically entitle you to refunds unless we choose to provide them at our discretion.
